El contrato de transporte continuado

Abstract

En la práctica empresarial de nuestro tiempo, la contratación aislada de operaciones de transporte se ve frecuentemente desplazada por el establecimiento de relaciones continuadas de transporte, dirigidas a la realización sucesiva de expediciones. La admisión de este tipo de transportes constituyó una de las principales innovaciones introducidas por la Ley 15/2009 y supuso un verdadero hito en configuración jurídica del contrato de transporte, superando su tradicional identificación con el viaje-expedición para dar entrada también a relaciones cuya vigencia se prolonga en el tiempo y sirven de marco a la realización de una pluralidad de expediciones. La delimitación del contenido de estos contratos pasa necesariamente por la combinación de su regulación legal con la autonomía de la voluntad de las partes y supone uno de los temas fundamentales que, actualmente, tiene planteados el Derecho de Transportes. A pesar de lo cual, la figura ha pasado casi inadvertida y no ha merecido la consideración debida por parte de nuestra doctrina.- In the business practice of our time, the isolated contracting of transport operations is frequently displaced by the establishment of continuous transport relationships, aimed at carrying out successive dispatches. The admission of this type of transport constituted one of the main innovations introduced by Law 15/2009 and represented a true milestone in the legal configuration of the transport contract, surpassing its traditional identification with the trip-dispatch to also give rise to relationships whose validity It lasts over time and serves as a framework for carrying out a plurality of expeditions. The delimitation of the content of these contracts necessarily involves the combination of their legal regulation with the autonomy of the will of the parties and represents one of the fundamental issues that Transportation Law currently has raised. Despite which, the figure has gone almost unnoticed and has not deserved due consideration by our doctrine.
