dc.description.abstractEsta tesis doctoral se ocupa de analizar el test del peligro claro e inminente (Clear and Present Danger test) formulado por la Corte Suprema de los Estados Unidos. Este test clásico en el constitucionalismo norteamericano diseña una original solución para el problema universal de cuales han de ser los límites de la libertad de expresión en un Estado democrático cuando lo que se cuestiona es el propio orden democrático. La tesis sostiene, al respecto, dos ideas principales. La primera es que, contrariamente a lo que se ha considerados en la mayor parte de la bibliografía sobre esta cuestión, más que de una teoría única de Clear and Present Danger que se ha ido depurando o perfeccionando por la Corte Suprema, lo que existe son varios modelos autónomos e independientes de Clear and Present Danger test. La segunda es que para entender adecuadamente la teoría del Clear and Present Danger no debemos conceptuar esta construcción como únicamente un test, esto es como una herramienta procesal, sino también como una doctrina que propone una determinada concepción constitucional sobre la libertad de expresión en los límites de la democracia. Esta tesis doctoral divide la exposición de estas cuestiones en tres partes. La primera estudia los antecedentes de la teoría del Clear and Present Danger. La segunda desarrolla el modelo originario de la teoría del Clear and Present Danger. La tercera expone los otros modelos de la teoria del Clear and Present Danger que cabe identificar en su evolución histórica. En concreto, aquí, se abordan su modelo invisible, su modelo expansivo, su modelo militante y su modelo ecléctico.spa
dc.description.abstractThis doctoral dissertation faces the specific history of the Clear and Present Danger test through its landmark cases in the U. S. Supreme Court. This classical U. S. test proposes a particular and original solution concerning the universal theoretic problem of which should be the boundaries of freedom of political expression in a democratic nation when democracy itself is questioned. Two main ideas are hold in this dissertation. First. Challenging the usual academic approach to this topic, this dissertation disagree with the traditional statement that there is a unitary theory of Clear and Present Danger that the Supreme Court has been refining or improving in its subsequent decisions. On the contrary, different and autonomous frameworks of this Theory can be identified. Second. In order to obtain a holistic understanding of the Clear and Present Danger Theory, we must not concept it just like a test (a judicial instrument) but also, as a constitutional doctrine about freedom of speech in the boundaries of democracy. The dissertation is structured in three different Parts. Part I analyzes the context and precedents of the Clear and Present Danger Theory. In Part II, the Original framework of the Theory is developed. Finally, Part III exposes the other models of this Theory appeared during its historic evolution. In particular, in this part the Invisible framework, the Expansive framework, the Militant framework and the Eclectic one are considered.eng
